SonoCue Terms of Service

These Terms of Service ("Terms") govern your use of the SonoCue mobile application and related services (the "Service"), provided by Pixel & Pulse Travelers ("we", "us", "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility — credentialed professional users only

You may use the Service only if you are at least 18 years old AND one of the following:

By signing up, you represent and warrant that you meet at least one of the above. The Service is not intended for, and may not be used by, patients, members of the general public, or untrained individuals.

We may, at our discretion, request reasonable verification of your professional status (e.g., ARDMS license number lookup) and may suspend or terminate accounts that we have reason to believe are operated by ineligible users.

You agree that you will not enter, upload, store, or transmit any Protected Health Information (PHI) as defined under the U.S. Health Insurance Portability and Accountability Act (HIPAA) into the Service. This includes, without limitation: patient names, medical record numbers (MRNs), Social Security numbers, dates of birth, telephone numbers, email addresses, photographs, biometric identifiers, full-face images, or any other identifier that could reasonably link clinical content to a specific individual.

If you breach this clause, we may immediately suspend or terminate your account. You acknowledge that the Service is a reference tool used to discuss anonymous, hypothetical, or aggregate clinical scenarios, not patient-specific data.

4. AI Analyze — important user obligations

When you use the AI Analyze feature, you specifically acknowledge:

  1. Output is suggestions, not diagnoses. AI Analyze returns a list of differential considerations, suggested next scan steps, and brief clinical context. Each output is preceded by an "AI-GENERATED · VERIFY BEFORE USE" warning.
  2. You verify against primary sources. AI output may contain inaccuracies. Before relying on any suggestion clinically, you must verify against current society guidelines (AIUM, ACOG, ISUOG, SMFM, ACR), peer-reviewed literature, your scan findings, and your clinical judgment.
  3. You will not use AI output for time-critical or emergency decisions. AI Analyze is for reference, not real-time clinical action.
  4. You can flag any output. Tap "Report this response" on any AI response to flag it for review.
  5. You will not enter PHI (see Section 3).
  6. Rate limit: AI Analyze is limited to 5 uses per account per day. Limits may change at our discretion.

6. HIPAA position

We are not a HIPAA "Covered Entity" or "Business Associate" of any healthcare provider. The Service is not designed to receive, process, store, or transmit Protected Health Information (PHI). Sections 3 and 4 prohibit you from entering PHI.

If you are a healthcare institution interested in a HIPAA-eligible enterprise tier with a Business Associate Agreement, contact us about the SonoCue Enterprise option (under development). The free SonoCue mobile application does not satisfy HIPAA requirements and may not be used in any workflow that handles patient-specific data subject to HIPAA.

The Phase 1 release of SonoCue is free. There is no subscription, no in-app purchase, and no paid tier. Future releases may introduce a paid tier; if so, separate Subscription Terms will apply and you will be notified before any charge.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM CLINICAL INACCURACIES.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, MEDICAL MALPRACTICE OR PATIENT-CARE OUTCOMES, OR DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (CURRENTLY ZERO, AS THE SERVICE IS FREE), OR (B) ONE HUNDRED U.S. DOLLARS ($100).

YOU SPECIFICALLY ACKNOWLEDGE THAT YOU ARE A TRAINED MEDICAL PROFESSIONAL, THAT YOU EXERCISE INDEPENDENT CLINICAL JUDGMENT, AND THAT YOU DO NOT RELY ON THE SERVICE AS THE SOLE BASIS FOR ANY CLINICAL DECISION. YOU ASSUME ALL RISK ARISING OUT OF YOUR PROFESSIONAL USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold us harmless from any claim, damages, liability, costs, or expenses (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your entry of PHI in violation of Section 3; (c) your reliance on the Service for time-critical or emergency clinical decisions; or (d) any clinical outcome you attribute to the Service.

12. Termination

We may suspend or terminate your account, with or without notice, if you breach these Terms, especially Sections 1 (eligibility) or 3 (no PHI). On termination, your account data will be deleted in accordance with our Privacy Policy.

You may terminate at any time by deleting your account in Settings.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of [Otis to confirm — typically your state of residence], without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved in the state or federal courts located in [Otis to confirm county/state], and you consent to personal jurisdiction in those courts.

If you live outside the United States, you may have additional non-waivable rights under your local consumer-protection laws — those rights are not affected.

14. Changes to these Terms

We may modify these Terms as the Service evolves. Material changes will be communicated through an in-app notice or by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
